By accessing or using the AnswR service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is operated by AnswR (ABN 59 633 141 321), based in Melbourne, Victoria, Australia.

2. Description of Service

AnswR provides an AI-powered virtual receptionist service that answers phone calls on behalf of your business, handles enquiries, books appointments, and provides call transcriptions and analytics.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements and have the authority to bind your business to these Terms.

4. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

5. Service Plans and Fees

5.1 Subscription Plans

The Service is offered on a monthly subscription basis. Current pricing and plan details are available on our website. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5.2 Payment Terms

• Subscription fees are billed monthly in advance
• Payment is processed through Stripe using the payment method on file
• Failed payments may result in service suspension
• All fees are in Australian Dollars (AUD) unless otherwise stated

5.3 Free Trial

New users may be eligible for a free trial period. At the end of the trial, you will be automatically enrolled in your selected plan unless you cancel before the trial ends.

6. Phone Numbers

Phone numbers provided through the Service remain the property of our telecommunications partners. Upon cancellation, you may port your number to another provider within 30 days, subject to regulatory requirements.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Engage in fraudulent, misleading, or deceptive practices
• Harass, abuse, or harm others
• Transmit spam, malware, or unsolicited communications
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization
• Use the Service for any illegal purpose

8. AI Service Limitations

You acknowledge that:

• The AI may not handle all call scenarios perfectly
• The AI is not a substitute for professional advice (legal, medical, financial, etc.)
• Call transcriptions may contain errors
• The Service requires proper configuration to function optimally

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and storage of data as described in the Privacy Policy.

10. Intellectual Property

The Service, including its software, design, content, and technology, is owned by AnswR and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for your business purposes only.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, ANSWR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless AnswR, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

14.1 By You

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period.

14.2 By Us

We may suspend or terminate your access to the Service immediately if you violate these Terms or engage in fraudulent activity. We may also terminate the Service with 30 days' notice for any reason.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

16. Dispute Resolution

Any disputes arising from these Terms shall be governed by the laws of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any disputes.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
